It projected itself as financial of Business Ethics. On December 2.2001 Enron Corp. Filed the largest bankruptcy in U.S history due to many unethical issues. The Enron Scandal shocked the world. Enron had an overwhelming aura of pride and carried with it the deep-seated belief that its people could handle increasing risk without any consequences. The culture promoted greed and focused on how much money could be made for executives. For, example Enrons compensation plans seemed less concerned with generating profits for shareholders than with enriching Companys wealth. Enrons corporate culture reportedly encouraged profiteering. The Enron collapse has sent shockwaves all over the financial world and raised serious questions regarding corporate governance. The Enron bankruptcy is becoming the most famous and highly publicized bankruptcy case in history. There are numbers of unethical issues that contribute Enron to its bankruptcy. They are as follows-: Improper Accounting: One of the major reason behind of its bankruptcy was improper accounting system. For example the company established the special-purpose entities (SPEs) to move the assestd and debt of its balance sheet and increase cash flow by showing through its books when it sold assets. Hiding the losses and inflating profits: The company has a cash flow of negative amount $154 millions, Enron claimed of 3 million in its cash flow Bad Communication-: Delivering the bad news. Lying to the various stakeholders, the financial statements hide the momentous losses to their Stockholders. Stock analysts were often vague and didnt specify their operation cost and their finances. Misleading the financial reports-: The bankruptcy filing came after revealing that Enron used (SPEs),Special Purpose Entities. SPEs hid losses. Enron used SPEs to move assets and debts off it balance sheet. This enables increase in its Cash Flow. Poor business and accounting procedures encouraged greed. Unregulated private partnerships(SPES) to take on debts Over 5000 Enron employees lost their livelihood due to Top Managements greed. Enrons VP Sherron Watkins consistently sent reports out to the then Chairman outlining improper accounting methods employed. The biggest problem was that Enron outsourced its internal audit function. Jeffrey McMahon told a congressional subcommittee that he had informed Skilling about the companys off-the-balance-sheet partnership in March 2000, when he was Enrons Treasurer. In 1993, Fastow created hundreds of special-purpose entities designed to transfer Enrons debt to an outside company and get it off the books-without giving up control of the assets that stood behind the debt. To prevent degrading in Enrons credit rating, Fastow tripled his staff, to more than 100.He hired various banking experts and giving them the task of selling and buying capital risk. This effectively allowed Enrons audited balance sheet to appear debt free, while in reality it owed more than 30 billion dollars at the height of its debt. While presented to the outside world as being independent entities, the funds Fastow created were to take write-downs off Enrons books and guaranteed not to lose money.. Fastow made tens of millions of dollars defrauding Enron in this way, while also neglecting basic financial practices such as reporting the cash on hand and total liabilities. Giles Darby, David Bermingham, and Gary Mulgrew worked for Greenwich NatWest. The three British men had worked with Fastow on a special purpose entity he had started called Swap Sub. When Fastow was being investigated by the SEC, the three men met with the British Financial Services Authority (FSA) in November 2001 to discuss their interactions with Fastow. Comparing My Last Duchess, La Belle Dame Sans Merci and A Woman to Her

Differing Views of Male-female Relationships in Three Poems In the three poems we experience three different views of how male-female relationships should take place. In ‘My Last Duchess’ we experience the view that the male should have the main role in relationships, in ‘La Belle Dame Sans Merci’ we hear of a relationship where the woman is in total control of the man and has all the power. Finally in ‘A Woman to Her Lover’ we read that both men and women should have an equal amount of power and no one should be dominant. In ‘My Last Duchess’ the thoughts of a very possessive and arrogant Duke of Ferrara are shared. He expected his wife to behave in a very conservative manner and wanted her to treat others as inferior. The Duke shows his position of power in the poem by referring to her as; ‘My Last Duchess’. The Duke uses the possessive pronoun ‘My’ which shows that the Duke doesn’t want anyone else to enjoy his wife’s company and he wants her all to himself. This shows that he has power over his wife as he refers to her as a belonging; it also shows that he is arrogant as well as dominant. Furthermore, we can see that the word ‘last’ implies that the Duke had previous wives; it also suggests that she is his duchess no more and so something must have happened to her. As a result of this we get the impression that the Duke simply marries then divorces, or kills, his wife just to receive her dowry, and to get more money. Also, we can see that when the Duke refers to the picture of his wife, he immediately names the well known artist that painted it; â€Å"I call that piece a wonder †¦ ‘Frà   Pandolf’†. Here we see that the Duke shows off the fact that his painting was created by a famous artist, he may ... ...her main type of imagery used is sensual imagery ‘Full beautiful’, ‘sweet moan’, here, Keats allows the reader to build up a picture of the woman which helps the reader to visualise why the knight can be controlled by her. In conclusion, we can see that wherever one individual in the relationship has had more power, whether it has been the man or woman, the relationship has ended in a sad state of affairs. In each poem the relationships are completely different, Browning’s poem views women as being inferior to men, Walsh’s poem views women and men as being equal and Keats views women as being faery’s, having supernatural powers and dominating the man. The main inference among the three poems is that the role of the sexes within a relationship can change, depending upon the characters in the relationships and the amount of power each person does posses.

The heart rate increases the second you entry the terminal. There is a continuous sound of cheerful chatter, luggage wheels gently rolling across the cobalt blue floor, and mobile phones ringing. There are different emotions on everyone as you walk past, some people are depressed, excited or stressed out. The cue is long because it’s the early hours in the afternoon; the security grads are comfortably waiting for the passengers to place their properties in the security check tray. Each security uniforms display a shining gold badge that catches the eye; it’s so bright you have to wear sun glasses to look at the badge. The security grads are standing straight and are eager and delighted to help the next traveller. A mother and her child are joyfully placing their properties in the security check tray. The little boy was obviously dressed to see someone special; wearing a dark blue jacket, a green and grey striped shirt underneath, his trousers are clean but you can recognize they have been worn a couple of times and he has spent much time on his knees probably playing with his bright yellow racing car he is now happily placing in the tray which is now passing through the security check. He jumps eagerly as the scanner beeps, a sigh of relief as the boy got his yellow car back. As the time gets closer for takeoff, the more pressure; you just can wait to get on the plane but the time is dragging is like watching a snail run a marathon. I hear two business men behind me chatting about the weather in New York and the possibility of a snow. The disturbance of an airplane at a takeoff and the smell of an aircraft fuel. Young children listening to music on their mp3 player some even singing it out loud and playing video games as they wait for their gate to open. Voice on the public address announcing that flight 1907 is now boarding at gate A28. A Multiple of Billboards adverting different type of things the most eye catching one is the toothpaste billboard, because the man is beating of the billboard and the billboard is half done. It makes it clear that Formula tooth care gives you really strong teeth. Several people where admiring the art work as they took pictures of the billboard.

The film seems to be extremely violent, even excessively violent from the contemporary standpoint. On the other hand, the film contains implications for sexually explicit scenes, which though are never shown in the film. Therefore, Scarface is the film that focuses on the violence and eliminates any moral and social boundaries of violent behavior but still remains ethically rigid in the depiction of sexually explicit scenes.  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   Sexually explicit scenes in the film are rather implicit and are not shown in the film in the way they would be shown in a present day film. For example, the visit of Poppy to Tony’s gaudy apartment gives implications to the continuation of the sexual s cene to follow the visit, but the film winds up the scene without the explicit continuation. Instead, a contemporary film would likely to continue the scene ending up with a sexually explicit scene of Tony and Poppy having love.  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   The violence is amply presented throughout the film. In fact, from the beginning the main character of the film, Tony manifests his inclination to use violence to resolve all problems. For example, he obtains promotion and becomes Jonny’s lieutenant after killing a Mafioso, who controlled the Southern side of the city, Big Louis Costillo.  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   Furthermore, the film continues to cover the violent nature of Tony’s ‘business as he takes control over bars and come into clashes with other gangsters. The film is full of violent scenes depicting the murder of gangsters as well as civilians. For example, the scene, when Guino kills O’Hara, the leader of the Irish gang that controlled the North of the city. Another violent scene is slaughtering of Irish gangsters in the garage by gangsters impersonating police officers.  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   At the same time, the film shows violent scenes which refer not only to the impersonal slaughter of numerous gangsters but it also uncovers the family tragedy of the main character, which also involves the extremely violent scene, when the sister of Tony is killed by a stray bullet. On the other hand, this scene is preceded by another violent scene, when Tony kills his friend, Guino, after seeing him with his sister, being unaware of their secret marriage. In fact, such violent acts have a profound impact on the audience because of the personal tragedy of each character involved in these scenes. They are not some gangsters, whom Tony does not know but they are people, who are very close to him, closest people, as the matter of fact. This is why such violent scenes have a partic ularly strong emotional constraint and the audience grows more and more involved in the film. Moreover, while watching these films, the audience has emotional turmoil since, on the one hand, the audience is shocked by extreme, apparently excessive and unreasonable violence, as was the case of Guino’s murder, and occasional, unreasonable and illogical killing of Tony’s sister by a stray bullet.  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   Thus, the film turns out to be extremely violent, even for the present audience. History of Halloween Essay Close to $7 billion dollars is what consumers spent on Halloween costumes, candy, and decorations in 2011. When the temperature starts to drop, the leaves turn different colors and the sun sets earlier little by little each day, fall is the perfect season to celebrate Halloween. Millions of children dress up and go to strangers doors begging for candy. Have you ever wondered where this strange and unique tradition originated from? The three most important points of Halloween can be summed up by looking at its origins, how it came to include jack-o-lanterns and bobbing for apples, and how it is celebrated today with trick-or-treating and haunted houses. Halloween, also known as All Hallows Eve, has originated from the ancient Celtic festival known as Samahin (sow-in) derived from the Old Irish Samuin meaning summers end. The Celts, who lived 2,000 years ago in the area that is now Ireland, the United Kingdom, and northern France, celebrated the end of the harvest season with the festival of Samhain and celebrated the upcoming new Year on November 1. Used by the ancient pagans, Samhain was a time to take stock of supplies and prepare for winter. October 31 was the day the ancient Gaels believed the boundaries overlapped between the worlds of the living and the dead, and the departed souls would come back to life and cause mayhem such as damaged crops and sickness. The Gaels built massive bonfires and summoned the help from gods through animal and possibly human sacrifices to ward of the spirits. It is believed that the fires attracted insects to the area which in turn attracted bats. These are additional features of the history of Halloween. Halloween is also thought to be influenced by the Christian holy days of All Saints Day, also known as Hallowmas, and All Souls Day falling on November 1 and 2. It was a time for honoring the saints and praying for the deceased who had yet to reach heaven. Traditionally it was believed that the departed souls roamed the earth until All Saints Day, and Hallows Eve delivered one last chance before moving on to the next world, to gain revenge on their enemies. Christians would  disguise themselves in costumes and masks to avoid being recognized by the wandering souls. Trick or treating is the practice of dressing up in costumes and going door to door begging for candy and resembles the late medieval practice of souling when the poor would proceed door to door on Hallowmas receiving food, or soul cakes which were pastries, and in return would pray for their dead relatives souls. It was believed at the time the souls of the departed would wait for passage into heaven until enough people prayed for their souls. Soul cakes would be given in exchange for a song, performance, or another sort of trick in some cultures. Eventually, children embraced this practice and were given money, food, and ale. Jack o lanterns are a Halloween staple today, with at least two historical roots. The first is the pagan Celtic people carved turnips and rutabagas to hold hot coal from the bonfire to light their homes and ward off the evil spirits. Another folklore tale gives jack o lanterns their name. An Irish myth portrays a trickster and a drunk known as Stingy Jack, who asked the devil to have a drink with him. Jack persuaded the devil to change himself into a coin so he could pay for his drink, but instead he put the coin in his wallet next to a silver cross, trapping the devil and preventing him to change himself back. Jack said he would free the devil if he did not bother him for another year. The following year Jack tricks the devil into climbing an apple tree for a piece of fruit. He then carved a cross in the bark of the tree preventing the devil from climbing down. In order to get down from the tree, the devil promised Jack he would not seek his soul anymore. Because of his swindling and drunken ways, when Jack died he was not allowed into heaven. He also was not allowed into Hell because the devil kept his word. Taking pity on Jack, the devil gave him an ember to light his way in the dark, putting it into a hollowed out turnip for Jack to carry on his lonely, everlasting roamings around the Earth. People from Ireland and Scotland  would make Jack o lanterns during this season to scare away Stingy Jack and other evil spirits wandering about. Over the next several centuries, superstitions about witches and black cats were added to the folklore and legends of Halloween. Cats were thought of as evil, especially black cats, and were killed by the thousands in Medieval times, possibly contributing to the Black Plague, due to the shortage of the rats natural enemy, the cat. During this time, the church created the belief that evil witches existed. Apples, which are a seasonal fruit, and the symbol of the Roman goddess Pomona, were thought at the time to retain qualities of knowledge, resurrection, and immorality. Bobbing for apples was thought to predict the future on the night of Samhain. (sow-in) Halloween eventually made its way over the Atlantic in the second half of the nineteenth century when America became flooded with new immigrants. Taking from Irish and English traditions, Americans began to dress up in costumes and go house to house asking for food or money, a practice that ultimately became todays trick-or-treat tradition. The 20th century saw an emergence of Halloween as a genuinely North American holiday and one that was becoming an advantage for shopkeepers and manufactures. Costuming became popular for Halloween parties for children and adults as well. The first mass-produced Halloween costumes appeared in stores in the 1930s when trick-or-treating was becoming popular in the United States. Halloween costumes are traditionally modeled after supernatural figures such as monsters, ghosts, skeletons, witches, and devils. Over time, the costume selection extended to include popular characters from fiction, celebrities, and generic prototypes such as ninjas and princesses. Haunted attractions are entertainment venues designed to thrill and scare patrons. Most attractions are seasonal Halloween businesses. Origins of these paid scare venues are difficult to pinpoint, but it is generally  accepted that they were first commonly used by the Junior Chamber International (Jaycees), who are a non-political youth service organization between the ages of 18 to 40, for fundraising. They include haunted houses, corn mazes, and hayrides, and the level of sophistication of the effects has risen as the industry has grown. Critical Evaluation of the research methodologies 1. Introduction: In this report I have critically reviewed the methodologies which are used by Chevrier in her research paper. In this paper I have revealed whether she has used the correct methodology for her research or not, whether her evidence support her findings or not and I have mentioned an alternative methods to improve her conclusion. Chevrier paper aims at better understanding the dynamics of international project groups and she focuses on how project leaders manage the cultural differences to overcome and to use national cultures, ethnic diversity efficiently and effectively in the multinational project team. In her research she has depict three kinds of cross-cultural practices which were implemented by the project leaders. With these findings she has proposed a strategy to enhance the functioning of cross-cultural projects. I think the methodology which she has used in this research i.e. Case study is largely fine but not an effective one instead of this if she had used Grounded theory methodology for this research it would have been much more better research. I argue that the three case studies which she has chosen is not a typical one of all the multinational project groups. I argue that the Data collection technique which she has used in this research i.e. informal discussion is not a good technique to collect the data from participant. I argue that the strategy which she has proposed doesnt hold good for all types of cross-cultural project groups. 2. Literature review: Research can be a tricky, fascinating, awkward, tedious, annoying, hilarious, confusing, disturbing, mechanical, sociable, isolating, surprising, sweaty, messy, systematic, costly, draining, iterative, contradictory, open-ended process (Anthias, 2002) Methodology is identical to a research model employed by a researcher in a particular project, including basic knowledge related to the subject and research methods in question and the framework employed in a particular context (Sarantakos, 1998 cited Lather, 1992:87). Sarantakos (1998) relates the nature of Methodology to a theoretical and more abstract context, and perceives it in conjuction with distinctive, unidimensional, and mutually exclusive theoretical principles. Methodologies offers the research principles which are related closely to a distinct paradigm translated clearly and accurately, down to guidelines on acceptable research practices. Methodology is determined not by the research model but rather by principles of research entailed in a paradigm. Case-study research involves studying individual cases, often in their natural environment, and for a long period of time and employs a number of methods of data collection and analysis. (Sarantakos, 1998 cited Kromrey, 1986:320) 3. Critical Analysis of her Methodology: In this research the Methodology which is used by Chevrier is Case study. I think to do this research survey studies or experimental strategies will be too complex to implement, this is the main reason for Sylvie to choose Case study as the Methodology for this research. Generally case studies are done by a researcher when he/she is interested in the structure, process and outcomes of a single unit. (Sarantakos, 1998) Case studies are done by a researcher when he/she wants to extract data from a single field of study. Here Chevrier has chosen Engineering (i.e. three Project groups) as a field of study in which she has extracted the data and processed into information in which it will fit into the research topic. But this research topic demands to do study on all different kinds of field; but Sylvie hasnt done it, this is the main drawback of this research paper. In this research Chevrier focuses on how project leaders deal with cultural differences to surmount and even benefit from the variety of national cultures in their team. They have studied three cross-cultural practices that the project leaders explicitly or implicitly use to manage their international team and also studied the related outcomes from these practices. I think some methods and techniques which are used by Chevrier in her research paper doesnt holds good to the research topic. I think the samples(case studies) which she has chosen for this research doesnt sounds well because she has chosen only three international project groups to study the cross-cultural practices which are implemented in the team and moreover all these three project groups has the same background i.e. engineering. I believe just three project groups of the same background will not give a good weightage to her research paper. This is mainly because other than these three project groups there are different types of multinational project groups in which they are directly related to the cross-cultural management which I think she should have taken into this research paper. This research paper is pointing towards Multinational groups but the project groups which she has chosen has only people who are from European countries and Brasil, it misses out people who are from Asia, Africa and Australia. In this field work data is collected from Formal interviews, attendance to their meetings as a participant observer and informal discussions. I think the Primary data obtained from the formal interviews with project leaders and project members will be useful to analyse the data in this research and this data is important because the members of the project groups are the one who will be following cross-cultural practices and they will be knowing whether these practices are useful or not . In her research she has used participant observer as a data collection technique. I think it is a good technique for collecting the data in this research. Since her team will be a part of the cross-cultural group so they can observe easily how the team members/managers will behave and whether they are following the cross-cultural practices or not. They have attended even meetings to collect the data I think this is the place where they might have got a good data because this is a place where they can observe whether the managers and leaders are following cross-cultural practices or are they giving any importance to it or not. Chevrier and her team was also present daily among the project groups particularly for project 1(for 2 project weeks) and project 2(for 2  ½ months), I think daily presence in a project group is important because generally people wont behave same way in every time/day and also we cant judge their behaviour on cross-cultural practices in a single day. So daily presence in a project group will give a good data for the researcher but interesting point in her data collection is she or her team was not present daily for project team 3 but they were present only in project team 1 2 and that to in project team 1 they were present daily with team for just 2 ‘project weeks, so I dont think within these 2 weeks they have collected a strong data because in just 2 weeks it is less practical to summarize their behaviour. I think the primary data which they have collected in project team 2 will be useful because for 2  ½ months they were daily present with the team so with this time they will be in a better position to judge their behaviour with respect to cross-cultural. I also think that the Informal discussion which she has used in this research is not an effective technique. I agree this technique partially and I also disagree partially. I think this technique should be used depending on the situation in the working environment; if the working environment is not so good then there is no use of having discussion with them because the interviewee may give answers simply just to pass time. I think they should use only when the team members are in a good mood and moreover this discussions will take place mainly during lunch time of the employees, this is the time where most of the employee will relax, spend time with their colleagues and chat with them, if Chevrier and her group starts to discuss with these employees then most of them wont be interested and they will just say something or they will give less answers so that the discussion will be over fast. She has analysed the collected data by Cutting of Tran scripted interviews and meeting notes by theme. She has prepared a monograph for each and every theme which I think its a good idea and it will be useful for comparing all the themes. This type of comparison will help to find out the common and uncommon features of all the cases 4. Will her evidence support her findings? I think the evidence which she has used in Case 1 will support her findings. This is a project group of European consortium set up to make RD in the telecommunication industry. The contract which is signed by these companies designates one company as a primary contractor which will appoint a project leader among its engineers. We know that the newly appointed project leader has no hierarchical authority over the other partners due to this he/she cannot demand anything from other partners, infact he/she cant expect that other partners will involve totally (100% commitment) in this project and there is also a possibility that this may also lead to lack of institutional management with the other partners. In this project the leader has to take some technical decisions in which sometimes it may not be accepted by the other partners as she found this from Northern Europe and especially from Scandinavia that they only speak up when they disagree with what is being said. These project groups were not totally involved in the project. In this case the project leader has no choice he has to tolerate with these kinds of partners. This is what Chevrier has found that the leader explicitly or implicitly relies on tolerance of team members to surmount difficulties. The project group (RD consortium) has people from different countries; definitely all of them will have different opinion on Cross-cultural activity. Some may tolerate the diversity and some may not. Chevrier has found out different opinions from the interviewees e.g. In multinational teams some team members tend to forget the nationality of their colleague to focus on technical issues. Oppositely, the second part of interviewees says that they make their best to struggle against prejudices, stereotypes and ethnocentrism. In the 2nd case of Chevrier it is said that the greatest difficulty for the project manager is to make the work required for his own project a priority for team members who are very much in demand. If this is the case most of the manager tries to protect his team members to work in his project because every manager will have some task to complete, so to do this task without skilled workers in his team it will be difficult for him to complete it. If the manager couldnt maintain these workers in his team then there is every chance of showing less interest in the project. This is what happened to Swiss manager as it is told in Chevrier paper that â€Å"Swiss manager straightforwardly declared he did not want to make any difference and was careful to manage all team members the same way.† Chevrier has also backed up this argument by giving the reference of Laurent (1998), â€Å"we observed that when managers encounter cross-cultural differences, they often do nothing and consider that it is legitimate not to talk about them.† In case 1 the main job of the project leader is to maintain a strong institutional management with the other partners. Since the leader doesnt have the hierarchical authority over the other partners it will be difficult to manage all the other partners. His main job is to get the task done, since he doesnt has the upper hand over other project members it will be difficult for him to give orders for other groups to complete the job. In chevriers research, for this problem she has founded that â€Å"developing personal relationship with one another in a team will set up working arrangements more easily. If they know each other very well, it will help them to become acquainted with one other†. This strategy will suit only for RD consortium project group because in this project all its partners doesnt know each other so this strategy may enable effective mutual agreements between all the partners. But it doesnt suit for Electrical engineering project infact it can reinforce negative stereotypes and polarization between cultural groups. This is true because in this project the Swiss manager straightforwardly declared that he did not want to make any difference and was interested to manage all team members the same way, if this strategy (developing personal relationship) is implemented in this project group it may result in other way because due to less involvement by Swiss manger there is a more chance of negative stereotypes and polarization between cultural groups. This may lead in such a way that project may not complete. The strategy which is proposed in this paper by Chevrirer (cultural mediator) suits good for some multinational project groups but for some project groups it doesnt. Since in this strategy cultural mediator has to invite the project members quite regularly to find out the exact problem, this is possible only when all the project members are meeting together quite regularly at some place but this strategy cannot be applied to some multi-national groups where the project members wont meet regularly. However, in a multi national group most of the time the project groups will be from different countries so it is not practical to implement this strategy because all groups are from different countries and also it will be difficult for all the members to attend the meeting if it is put up by cultural mediator. As we can see in RD consortium group all the team members meet each other only four or five times a year. During these weeks all the project members will be busy with other partners about their plan and objectives in their project. So if this strategy is applied to this group then cultural mediator will not find sufficient time to spend with the team members to talk about their problematic situations which have encountered. I think this strategy can be applied to the project team in electrical engineering because this team is composed of a project manager, engineers who are all located in a single building but in a different floor. In this team cultural mediator can easily set up a meeting with the team members and find out the problematic situations which have encountered. Even in the product development project have subsidiaries which are located in different countries such as Germany, France, Belgium and Italy and co-ordinating the development process is in charge by ‘‘central group which is located in the French subsidiary. So even in this project group cultural mediator will find difficult to set up a meeting to talk about their problematic situations which have encountered. I think she has not justified all the problems which will occur in the multinational group. For e.g.— Race can be a problem in the group. Merriam et.al. in their research has found that â€Å"Racism was the specific dominating factor in cross cultural groups†. Color As an issue of concern amongst Blacks, colorism is examined and debated in Black communities in a less than open manner. This intraracial discrimination among Blacks gives preferential treatment to those who have lighter skin shades. (Merriam et.al) 5. Alternative Methodology: I think Grounded theory analysis will be a better approach for this research because in this research topic we need to analyse more number of case studies, interviews and observation so I think grounded theory will be the best methodology for this research. Another reason for using grounded theory techniques is â€Å"Grounded theorising is well suited to capturing the interpretive experiences of owner/managers/employees and developing theoretical propositions from them.† Rowlands B. (2005 cited from Strauss Corbin 1990) From the above reason we can say that, Since Chevriers research is related to the cross-cultural practices which are followed by Leaders, Managers, and Team members, so this methodology will be very useful in gathering and analysing the data. Similarly, Grounded theory has been effectively used in recent Information System research to develop theory of Information System practice. Rowlands B. (2005 cited from Urquhart et.al., 1997) In choosing the International project groups Chevrier has chosen the groups in which all groups has the same background i.e. Engineering. Instead of choosing three project groups from a single background she could have chosen three project groups from different fields. Because choosing a sample project group which is typical to that environment is very important and the data collected from this typical one will bee much stronger than the data which she has collected from the three Engineering project groups. I think Ethnographic interview will be useful to get valuable data from the interviewee. The main aim of this type of interview is to study the Culture of the people and to find out how it will impact on the people behaviour. â€Å"It aims to discover or understand the culture of people in their social environment and of explaining the social justification of their role and position in that culture.†(Sarantakos, 1998). This interview would have helped her in finding the culture of the project members/leaders and based on her understanding on their culture she could have compared with the Cross-cultural practices which were implemented by the management and she could have got a better result. If Chevrier had used all the above methodology in her research, I think this would have improved her research conclusion. 6. Conclusion: In this paper I have revealed that the methodology which is used by chevrier for her research is not a good one. I have shown that some of her methodology which she has used is not effective with respect to the research. The three case study which she has chosen in her research is not a typical one because all the case studies had the same background i.e. Engineering, instead of that she could have chosen case studies which are from different background and I also showed that the data collected from participant observation in project group 2 was strong. I showed that the data collected from informal discussion technique was not good. This paper reveals that Ethnographic interview and Grounded theory would have helped her to collect the strong data and to analyse the data which she has collected. I have shown that up to what extent of her evidence will support her findings. In this paper I have also concluded that her proposed strategy will holds good only if all the project members/g roups are in the same company or at least in the same country, it doesnt suit if all the project members/groups are in a different countries. 8. Social Isolation In The Interesting Narrative Of The Life Of Olaudah Eq

Olaudah Equiano in his Interesting Narrative is taken from his African home and thrown into a Western world completely foreign to him. Equiano is a slave for a total of ten years and endeavors to take on certain traits and customs of Western thinking. He takes great pains to improve himself, learn religion, and adopt Western mercantilism. However, Equiano holds on to a great deal of his African heritage. Throughout the narrative, the author keeps his African innocence and purity of intent; two qualities he finds sorely lacking in the Europeans. This compromise leaves him in a volatile middle ground between his adapted West and his native Africa. Olaudah Equiano takes on Western ideals while keeping several of his African values; this makes him a man associated with two cultures but a member of neither. Olaudah Equiano during his long journey is exposed to Western ideas and customs. Although he is initially frightened by them, writing "and I was now persuaded that I had gotten into a world of bad spirits, and that they were go to kill me" (755), he eventually begins to see Europeans as "men superior to us" (762). In this change of perceptive Equiano begins to endeavor to emulate his more pale counterparts. To further this cause, he begins to improve himself through education. He embarks on a quest to read and write having already partially learned his adopted tongue some two to three years after he arrives in England. He is put into school by Miss Guerins while his master's ship is in port and while in her service Equiano is taught Western Christianity and baptized. He thus begins to take on the European religious character as well as the new Enlightenment ideal of self-improvement. During Equiano's service... ...other leaving him somewhere between both. Olaudah Equiano's Interesting Narrative provides insight into cultural assimilation and the difficulties such assimilation. The writer embraces several Western traits and ideals yet guards his African virtues jealously. In doing so however, he finds himself somewhere in between a full European and a displaced African. This problem of cultural identity Equiano struggled with is still present in modern American society. The modern day African-American appears to also be in the process of deciding the between two competing cultures and often being left somewhere in middle becoming a victim of cultural identity just like Olaudah Equiano some 250 years ago. Misrepresentation of Love Essay -- Analysis, St. Augustine’s Confessio

â€Å"Our hearts find no peace until they rest in you† (21). The return to God, the means of doing so, and the manners by which man is turned from him in the first place, are central themes in St. Augustine’s Confessions; a historical work serving as confession, praise, and examination of faith. Autobiographical in nature, Augustine’s work retells the story of his life and of his spiritual journey in retrospect, considering each event and its importance to the larger framework of his religious philosophy, a result of the merging of Neo-Platonist thought and Catholic theology. Through this fusion, Augustine is able to reconcile God and â€Å"evil,† make a distinction between the physical and spiritual realms, and lay out his views on how one can come to know and love God the truest sense possible; how one returns to him. One of the main problems Augustine had as he began his examination of spiritual matters was the apparent existence of evil. Augustine was unable to reconcile the notion of God as unchanging and all-powerful with the evil that he saw in the world. If God was indeed omnipotent and the creator of all, how could evil exist if God did not have a hand in its making? Thus in his earlier years, Augustine fell in with the Manicheans, who held that God was not omnipotent, but rather in constant battle with evil and opposite force. Such ideas of evil and of God’s connection to the physical realm drove Augustine further from God. Fortunately, Augustine became dissatisfied with the Manicheans, whose flowery words proved to lack substance, and whose cosmological predictions proved less accurate than science and frequently a product of coincidence. Even after rejecting the dualism of Manichean thought, Augustine struggled to re... ...to be God-like, or even simply closer to God, being grounded in the tangible world, attempts are frequently and inappropriately invested in the physical realm, ultimately driving one further from God. Most sins are really just misdirected attempts to be like God. â€Å"Sloth poses as the love of peace...Extravagance masquerades as fullness and abundance†¦The spendthrift makes a pretence of liberality...The envious struggle for preferment†¦Grief eats away its heart for the loss of things which it took pleasure in desiring, because it wants to be like you, from whom nothing can be taken away† (50). Though introspection, we can pull ourselves from physical matters to spiritual matters, searching the soul for an inner memory of God, and thus better serve God (and the Force). Ultimately, love is not wrong, so long as love is through God. â€Å"Love them, then, in Him† (82).

Employee Grievances Essay

In industrial context the word grievance is used in industrial context to designate claims by workers of a Trade Union concerning their individual or collective rights under an applicable collective agreement, individual contract of employment, law, regulations, work rules, custom or usage. Such claims involve questions relating to the interpretation or application of the rules. The term â€Å"Grievance† is used in countries to designate this type of claim, while in some other countries reference is made to disputes over â€Å"right† or â€Å"legal† disputes. The grounds for a grievance may be any measure or situation which concerns the relations between the employers and worker or which affects the conditions of employment of one or several workers in the undertaking when that measure or situation appears contrary to provisions of an applicable collective agreement or of an individual contract of employment, to work rules, to laws or regulations or to the custom or usage of the occupational branch of economy activity or country†. Causes for Grievance Grievances generally arise from the day to day working relations in an undertaking, usually a worker or trade union protest against or act or omission of management that is considered to violate worker rights. Grievances typically arise on such matters like discipline and dismissal, the payment of wages & other fringe benefits, working time, over time and time off entitlement, promotions, demotions and transfer, rights deriving from seniority, rights of supervisors and the Union officers, job classification problems, the relationship of works rules to the collective agreement and fulfillment of obligations relating to safety and health as laid down in the agreement. Such grievances, if not dealt with a procedure that secures the respect of parties, can result in embitterment of the working relationship and a climate of industrial strife. Procedure for Settlement: It has been widely recognized that there should be an appropriate procedure through which the grievances of workers may be submitted and settled. This recognition is based both on consideration of fairness and justice, which requires that workers’ claims regarding their rights should receive fair and impartial determination, and on the desire to remove from the area of power conflict a type of dispute that can properly be settled through authoritative determination of the respective rights and obligations of parties. Essence of Model Grievance Procedure: The three cardinal principles of grievance settlement, under the procedure, are; 1. Settlement at the lowest level, 2. Settlement as expeditiously as possible; and 3. Settlement to the satisfaction of the aggrieved Like justice, grievance must not only be settled but also seem to be settled in the eyes of the aggrieved. The Model Grievance Procedure has a three tier system for the settlement at the levels of the 1. immediate supervisor; 2. departmental or factory head; 3. and a bipartite grievance committee representing the management and the union, with a provision for the arbitration appeal to the organization head, and a specified time limit for the resolution process. Views of the National Commission on Labour NCL has recommended that a formal grievance procedure should be introduced in units employing 100 or more workers and they are: 1. There should be a statutory backing for the formulation of an effective grievance procedure which should be simple, flexible, less cumbersome and more or less n the lines of Model Grievance Procedure, 2. It should be time bound and have a limited number of steps namely, approach to the immediate supervisory staff; appeal to the departmental head/manager; and appeal to the bipartite grievance committee representing management and the recognized Union. 3. A grievance procedure should be such that it gives a sense of satisfaction to the individual worker, ensures reasonable exercise of authority to the manager and a sense of participation to Unions, 4. The constitution of the grievance committee should have a provision that in case a unanimous decision is not possible, the unsettled grievance may be referred to arbitration. At the earlier stages the worker should be free to be represented by a co worker and later by an officer of the union, if one exists, 5. It should be introduced in all units employing 100 or more workers. INDISCIPLINE/MISCONDUCT Discipline is the employee self control which prompts him to willingly co- operates with the organizational standards, rules, objectives, etc. Misconduct is the transgression of some established and definite rules where no discrimination is left to the employee. It is violation of rules. Any breach of these rules and discipline may amount to misconduct. It is an act or conduct which is prejudicial to the interest of the employer or is likely to impair the reputation of the employer or create unrest and can be performed even outside the premises of the establishment and beyond duty hours. It is for the management to determine in its Standing Orders as to what shall constitutes acts of misconduct and to define the quantum of punishment for them. Causes of misconduct: †¢ †¢ Unfair labour practices and victimization on the part of employers, like wage diffentials, declaration of payment or non payment of bonus, wrongful works assignments, defective grievance procedure etc., †¢ †¢ Bad service conditions, defective communications by superiors and ineffective leadership lead to indiscipline, †¢ †¢ Poverty, frustration, indebtedness, generally overshadow the minds of the workers, these agitate their minds and often result in indiscipline, †¢ †¢ Generally speaking absenteeism, insubordination, dishonesty and disloyalty, violation of plant rules, gambling, incompetence, damage to machine and property, strikes, etc., all lead to industrial indiscipline. Remedial Measure for Acts of Indiscipline: †¢ †¢ Labour is most important factor of production. Therefore an Organization can prosper only if labour is properly motivated towards the attainment of specific goals. A more humane approach is necessary to motivate them. †¢ †¢ Each worker, as an individual, needs a fair or reasonable wage to maintain himself and his family in good health and spirits. So the wage should be adequate so that the worker may meet the economic needs of his family, †¢ †¢ He Trade Union leadership should be developed from within the rank and file of workers, who would understand their problems and put it up to the management in the right perspective. Disciplinary Action: Indiscipline is the result of many interrelated reasons- economic, psychological, social etc. It needs to be properly handled. The disciplinary action must conform to certain principles e.g. †¢ †¢ The principal of natural justice must guide all enquiries and actions. No biased person to conduct inquiry, †¢ The principal of impartiality or consistency must be followed, †¢ †¢ The disciplinary authority should offer full opportunity to the worker to defend himself . Procedure for Punishment: †¢ Framing and Issuing of Charge sheet †¢ †¢ Receiving the defendants’ Explanation †¢ †¢ Issuing the notice of Inquiry †¢ †¢ Holding the Enquiry †¢ †¢ Findings of the Inquiry Officer †¢ †¢ Decision of the Disciplinary Authority †¢ †¢ Communication of the Order of Punishment Termination of Employment: †¢ †¢ Voluntary abandonment of Service by the Employee †¢ †¢ Resignation by the employee †¢ †¢ Discharge by notice thereof given by the employer †¢ †¢ Discharge or dismissal by the employer as a punishment for misconduct, †¢ †¢ Retirement on reaching the age of superannuation Type of Punishment Under Standing Orders: 1. Sample of labour grievance handling policy in a manufacturing unit: As a matter of Labour Policy name of the company, hereby lays down the following procedure for addressing employees’ grievances 1 An employee who has any grievances viz., (a) A complaint against their supervisor or co-worker (b) Problems related to methods or systems in the production floor (c) Inconveniences caused due to work environment (d) Disturbances caused by personal problems in the factory premises etc. 2 Apart from the above the management may take other problems which it may consider relevant 3 The aggrieved worker shall inform their problems in writing to any one of the following – Factory Manager Technical Manager Admin Officer Welfare Officer 4 The gist of grievances of the employee shall be recorded in Employee’s Grievance Register mentioning the date and reference number if any 5 The registered complaints will be addressed within 48 hours 6 Employee may also drop their letter of grievance in the suggestion/complaint boxes kept in the production floor. 7 If the problem stated in the letter is found crucial the Factory Manager shall call concerned department head explanation and may order for enquiry. 8 The enquiry shall be done and redressal shall be made as per the company’s standing orders in force. 9 The action taken by the management will be recorded 10 The management shall refer the problems registered and action taken to solve it periodically and thus monitor the situation and ensure that the problems are not repeated. This policy on procedure for redressal is introduced to ensure good working environment in the factory, maintained at all time. Be it enacted by Parliament in the Sixtieth Year of the Republic of India as follows:- 1. (1) This Act may be called the Industrial Disputes (Amendment) Act, 2010. (2) It shall come into force on such date as the Central Government may, by notification in the Official Gazette, appoint. 2. In the Industrial Disputes Act, 1947 (hereinafter referred to as the principal Act), in section 2, -. (i) in clause (a),- (a) in sub-clause (i), for the words â€Å"major port, the Central Government, and†, the words â€Å"major port, any company in which not less than fifty-one per cent of the paid-up share capital is held by the Central Government , or any corporation, not being a corporation referred to in this clause, established by or under any law made by Parliament, or the Central public sector undertaking , subsidiary companies set up by the principal undertaking and autonomous bodies owned or controlled by the Central Government, the Central Government and† shall be substituted: (b) for sub-clause (ii), the following sub-clause shall be substituted, namely:- â€Å"(ii) in relation to any other industrial dispute , including the State public sector undertaking, subsidiary companies set up by the principal undertaking and autonomous bodies owned or controlled by the State Government, the State Government.†; Provided that in case of a dispute between a contractor and the contract labour employed through the contractor in any industrial establishment where such dispute first arose, the appropriate Government shall be the Central Government or the State Government, as the case may be, which has control over such industrial establishment.†; (ii) in clause (5), in sub-clause (iv), for the words â€Å"one thousand six hundred rupees†, the words â€Å"ten thousand rupees† shall be substituted. 3. Section 2A of the principal Act shall be numbered as sub-section (1) thereof and after sub-section (l) as so numbered, the following sub-sections shall be inserted, namely:- â€Å"(2) Notwithstanding anything contained in section 10, any such workman as is specified in sub-section (1) may, make an application direct to the Labour Court or Tribunal for adjudication of the dispute referred to therein after the expiry of three months from the date he has made the application to the Conciliation Officer of the appropriate Government for conciliation of the dispute, and in receipt of such application the Labour Court or Tribunal shall have powers and jurisdiction to adjudicate upon the dispute, as if it were a dispute referred to it by the appropriate Government in accordance with the provisions of this Act and all the provisions of this Act shall apply in relation to such adjudication as they apply in relation to an industrial dispute referred to it by the appropriate Government. (3) The application referred to in sub-section (2) shall be made to the Labour Court or Tribunal before the expiry of three years from the date of discharge, dismissal, retrenchment or otherwise termination of service as specified in sub-section (1).† 4. In section 7 of the principal Act, in sub-section (3), after clause (e), the following clauses shall be inserted, namely:- â€Å"(f) he is or has been a Deputy Chief Labour Commissioner (Central) or Joint Commissioner of the State Labour Department , having a degree in law and at least seven years’ experience in the labour department after having acquired degree in law including three years of experience as Conciliation Officer: Provided that no such Deputy Chief Labour Commissioner or Joint Labour Commissioner shall be appointed unless he resigns from the service of the Central Government or State Government, as the case may be, before being appointed as the presiding officer; or (g) he is an officer of Indian Legal Se rvice in Grade III with three years’ experience in the grade.† 5. In section 7A of the principal Act, in sub-section (3), after clause (aa), the following clauses shall be inserted, namely:- â€Å"(b) he is or has been a Deputy Chief Labour Commissioner (Central) or Joint Commissioner of the State Labour Department, having a degree in law and at least seven years’ experience in the labour department after having acquired degree in law including three years of experience as Conciliation Officer: Provided that no such Deputy Chief Labour Commissioner or Joint Labour Commissioner shall be appointed unless he resigns from the service of the Central Government or State Government, as the case may he, before being appointed as the presiding officer; or (c) he is an officer of Indian Legal Service in Grade III with three years’ experience in the grade.† 6. After section 9B of the principal Act, for chapter IIB, the following Chapter shall be substituted, namely:- â€Å"CHAPTER IIB GRIEVANCE REDRESSAL MACHINERY 9C. (l) Every industrial establishment employing twenty or more workmen shall have one or more Grievance Redressal Committee for the resolution of disputes arising out of individual grievances. (2) The Grievance Redressal Committee shall consist of equal number of members from the employer and the workmen. (3) The chairperson of the Grievance Redressal Committee shall be selected from the employer and from among the workmen alternatively on rotation basis every year. (4) The total number of members of the Grievance Redressal Committee shall not exceed more than six: Provided that there shall be, as far as practicable, one woman member if the Grievance Redressal Committee has two members and in case the number of members are more than two, the number of women members may be increased proportionately. (5) Notwithstanding anything contained in this section, the setting up of Grievance Redressal Committee shall not affect the right of the workman to raise industrial dispute on the same m atter under the provisions of this Act. (6) The Grievance Redressal Committee may complete its proceedings within forty-five days on receipt of a written application by or on behalf of the aggrieved party. (7) The workman who is aggrieved of the decision of the Grievance Redressal Committee may prefer an appeal to the employer against the decision of Grievance Redressal Committee and the employer shall, within one month from the date of receipt of such appeal, dispose off the same and send a copy of his decision to the workman concerned. Nothing contained in this section shall apply to the workmen for whom there is an established Grievance Redressal Mechanism in the establishment concerned.† 7. In section 11 of the principal Act, after sub-section , the following sub-sections shall be inserted, namely:- â€Å"(9) Every award made, order issued or settlement arrived at by or before Labour Court or Tribunal or National Tribunal shall be executed in accordance with the procedure laid down for execution of orders and decree of a Civil Court under order 21 of the Code of Civil Procedure , 1908. (10) The Labour Court or Tribunal or National Tribunal, as the case may be, shall transmit any award, order or settlement to a Civil Court having jurisdiction and such Civil Court shall execute the award, order or settlement as if it were a decree passed by it.† 8. In section 38 of the principal Act, in sub-section (2),- (i) clause (ab) shall be omitted; (ii) for clause (c), the following clause shall be substituted, namely:- â€Å"(c) the salaries and allowances and the terms and conditions for appointment of the presiding officers of the Labour Court, Tribunal and the National Tribunal including the allowances admissible to members of Courts, Boards and to assessors and witnesses;†.
